These Terms of Use ("Terms") govern your access to and use of the LittleGuest mobile application (the "App"), provided by Spontandom Studio LLC ("Company," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App on your own behalf. If you are using the App to manage information on behalf of children, you represent that you are their parent or legal guardian.
2. Description of Service
LittleGuest is a personal organization tool that helps parents and guardians track birthday party invitations for their children, including RSVP status and gift planning. The App does not require a user account, and party and children information you enter is stored locally on your device as described in our Privacy Policy.
3. Subscriptions and Billing
The App offers an optional premium subscription tier with additional features. Subscriptions are billed and managed through the Apple App Store or Google Play, as applicable, and are subject to their respective terms, including automatic renewal unless canceled at least 24 hours before the end of the current billing period.
To cancel or manage your subscription, use your Apple ID or Google Play account settings — we do not have the ability to process cancellations or refunds directly. Refund requests are subject to the applicable app marketplace's refund policy.
Pricing is displayed within the App and the applicable app marketplace at the time of purchase and may change upon renewal with notice as required by the applicable marketplace.
4. Acceptable Use
You agree not to:
- use the App for any unlawful purpose;
- attempt to reverse engineer, decompile, or interfere with the App's normal operation;
- use the App's invite scanning feature to submit content you do not have the right to share; or
- misrepresent your affiliation with LittleGuest or any third party.
5. AI-Assisted Features
The App's invite scanning feature uses automated processing to extract party details from photos and links you submit. Extracted details are provided for your convenience only, may be inaccurate or incomplete, and are always presented for your review before being saved. You are solely responsible for verifying the accuracy of any information before relying on it.
6. Third-Party Content
The App's invite-scanning feature may process content that originates from third-party invitation and event platforms. LittleGuest is not affiliated with, endorsed by, or sponsored by any such platform. We do not guarantee that scanning will remain compatible with any third-party platform's format or availability, and this feature may be modified, limited, or discontinued at any time without notice.
7. Intellectual Property
The App, including its design, graphics, and underlying software, is owned by the Company and protected by applicable intellectual property laws. Data you enter into the App remains yours; we claim no ownership over it.
8. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any AI-assisted feature will be accurate or continuously available.
9. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App, even if advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the App shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising out of your misuse of the App or violation of these Terms.
11. Termination
We may suspend or discontinue your access to the App's premium features at any time if we reasonably believe you have violated these Terms. Because the App does not use accounts, this generally takes the form of disabling access to backend-dependent features (such as invite scanning) rather than account termination.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles, except where superseded by applicable app marketplace terms or consumer protection laws that cannot be waived.
14. App Marketplace Acknowledgment
If you downloaded the App from the Apple App Store, you additionally acknowledge that: these Terms are between you and the Company only, not Apple; Apple has no obligation to provide maintenance or support for the App; Apple is not responsible for any product warranties, whether express or implied by law, and any warranty claims are the Company's sole responsibility to the extent not disclaimed; Apple is not responsible for addressing any claims relating to the App or your use of it; Apple is not responsible for investigating, defending, or resolving any claim of third-party intellectual property infringement; you represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
